Terms and Conditions for QRMENUE

Welcome to QRMENUE (the "Service"). This Service is a digital platform that provides a QR code menu system and Kitchen Order Ticket (KOT) software to restaurants, cafes, and other food and beverage businesses ("Restaurant," "You," "Your"). This Terms and Conditions agreement ("Agreement") is a legally binding contract between you and Webcypher Technologies (OPC) Pvt. Ltd.("We," "Us," "Our").

By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service.

1. Description of Service

Our Service allows you to:

  • Create and manage a digital menu accessible to your customers via a QR code.
  • Receive and process customer orders placed through the digital menu.
  • Generate digital or printed Kitchen Order Tickets (KOTs) and/or Bar Order Tickets (BOTs) to streamline communication between the front-of-house and kitchen/bar.
  • Manage a real-time order queue and status updates.
  • Handle billing and payment processes, where applicable.
 
2. User Accounts and Registration

  • Eligibility: To use our Service, you must be a legal entity or a business representative authorized to operate a food and beverage establishment.
  • Account Information: You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update it promptly if there are any changes.
  • Unauthorized Use: You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.
 
3. Restaurant Responsibilities

  • Menu Accuracy: You are solely responsible for the content, accuracy, and currency of your digital menu, including item descriptions, pricing, images, and availability. We are not liable for any discrepancies or errors in your menu.
  • Order Fulfillment: You are responsible for the timely and accurate fulfillment of all orders placed through the Service. This includes but is not limited to food preparation, quality control, and customer service.
  • Compliance: You agree to comply with all applicable local, state, and federal laws, including those related to food safety, hygiene, and the sale of alcoholic beverages.
  • Customer Interaction: You are responsible for all direct interactions with your customers, including resolving any disputes, complaints, or issues related to their orders or dining experience.
4. Customer Orders and Payments

  • As-Is Service: The Service acts as a digital conduit for orders. We are not a party to the transaction between you and your customer. The contract for the sale of food and beverages is solely between you and the customer.
  • Payment Processing: If our Service includes an integrated payment gateway, we are not responsible for any issues related to the payment processing service. Any disputes regarding payments, chargebacks, or refunds are to be resolved directly between you and your customer or the payment processor.
 
5. Intellectual Property

  • Our Property: The Service, including all software, design, text, graphics, and other content, is our exclusive property and is protected by intellectual property laws. Your use of the Service does not grant you any rights to our intellectual property.
  • Your Content: You retain all intellectual property rights to the content you upload to the Service, such as your menu, logo, and images. By using the Service, you grant us a non-exclusive, royalty-free license to use, display, and distribute your content for the sole purpose of providing the Service.
 
6. Limitation of Liability

  • Disclaimer of Warranties: The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
  • Limitation of Damages: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or business interruption, arising from your use or inability to use the Service. Our total liability to you for any and all claims shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
 
7. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for any reason, including but not limited to a breach of this Agreement. You may also terminate your account at any time. Upon termination, all provisions of this Agreement that by their nature should survive termination shall remain in effect.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in Bangalore, and you consent to the jurisdiction of such courts.

9. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will provide notice of any changes by updating the "Last Updated" date at the top of this document. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms and Conditions.

By using this Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
